Consumer Protection & High-Value Claims

A failed insurance claim worth ₹2 crore. A builder who took 8 years on a 3-year project. A medical procedure that went wrong. A luxury car with a manufacturing defect. Consumer law in India has stronger teeth than most defendants assume, the Consumer Protection Act 2019 expanded jurisdiction, expedited timelines, and made compensation realistic. LawCrust files and litigates high-value consumer claims at the District, State, and National Commission levels.

Background

What consumer protection and high-value claims covers

The Consumer Protection Act 2019 (replacing the 1986 Act) created a three-tier consumer forum, District (claims up to ₹50 lakh), State (₹50 lakh to ₹2 crore), and National Commission (above ₹2 crore). Jurisdiction includes deficiency of service, defective goods, unfair contracts, and product liability. RERA (Real Estate Regulation and Development Act 2016) operates in parallel for real-estate disputes. Insurance disputes can also go to the Insurance Ombudsman (claims up to ₹50 lakh) or directly to the consumer forum.

What We Handle

  • Banking deficiency claims (RBI Master Direction-aligned)

Who It's For

HNI individuals, NRIs, and families with high-value consumer disputes (insurance, real estate, medical, luxury goods, financial services) seeking compensation through Indian consumer forums.

How It Works

A Four-Step Path to Clarity

  1. 01
    Claim scoping call

A 30-to-45-minute call to scope the deficiency, the documentary record, the quantum, and the appropriate forum.

  2. 02
    Demand notice & filing

Statutory notice issued; complaint drafted and filed before the appropriate forum (District, State, National, RERA, NCLT, or Ombudsman).

  3. 03
    Evidence & hearings

Affidavit evidence, expert reports (medical, surveyor, valuation), and oral arguments through the hearing schedule.

  4. 04
    Order & execution

Final order secured; execution proceedings if the opposite party does not comply; appellate review where appropriate.

Cross-Border Matters, India Jurisdiction

Indian consumer forums (District, State, National Commissions), RERA, NCLT, and Insurance Ombudsman are all Indian-jurisdiction tribunals. LawCrust handles the entire complaint. Where the defective service or product originates abroad, we use Indian-jurisdiction reach over the local intermediary, distributor, or platform-grievance officer.

Common Questions

Consumer Protection & High-Value Claims, Asked & Answered

My ₹2 crore health insurance claim has been rejected. What is my recourse?

File a complaint before the State Consumer Commission (jurisdiction up to ₹2 crore) or directly before the National Consumer Commission (above ₹2 crore). The complaint can claim the full insured sum, interest from date of repudiation, and compensation for harassment. Most disputed health-insurance claims settle within 18 to 30 months at the Commission level. Parallel route: Insurance Ombudsman for claims up to ₹50 lakh.

A Mumbai builder is 5 years late on flat possession. RERA or Consumer Commission?

Both are available, but RERA is generally faster and the remedies are stronger for delayed possession (interest at SBI MCLR plus 2%, refund with interest, possession with penalty). File a complaint under Section 31 of the RERA Act before the Maharashtra RERA Authority. Where the builder has gone into corporate insolvency, the NCLT route under Section 7 of IBC may also be triggered.

My elderly parent suffered medical negligence resulting in serious injury. What can we claim?

Medical negligence claims before consumer forums can include actual medical costs, future medical costs, loss of income (where applicable), pain and suffering, and compensation for loss of consortium for family members. The National Consumer Commission and Supreme Court have awarded amounts ranging from ₹10 lakh to ₹5 crore in landmark cases, depending on severity, age, dependents, and the egregiousness of the negligence.

I bought a luxury car with a serious manufacturing defect. The dealer is dodging. What now?

Under the Consumer Protection Act 2019 + product liability provisions (Sections 82-87), you can claim full refund, replacement, or compensation for defective goods. For high-value items above ₹2 crore, file directly before the National Consumer Commission. The 2019 Act added a clear product-liability framework, manufacturers cannot dodge behind dealers anymore. Filing speed matters, manufacturers often settle pre-hearing.

My travel-insurance claim was denied after I had a heart attack abroad. Can I fight this?

Yes. Travel-insurance denials usually rest on "pre-existing condition" or "non-disclosure" arguments. These are vigorously contested at consumer forums, the bar for proving non-disclosure is high, and insurers often lose. Where the medical event was genuinely unforeseen, recovery rates at the State and National Commissions are favourable to claimants. We have recovered amounts ranging from ₹15 lakh to ₹2 crore in such matters.

My online order from a foreign e-commerce platform was defective. Can I file in India?

Yes. The Consumer Protection Act 2019 expressly covers online sellers and aggregators, and an Indian consumer can file in the District/State Commission where they reside, even if the seller is abroad. Recent NCDRC rulings have held foreign platforms liable for deficiencies in supply to Indian consumers. Jurisdictional service is via Indian intermediary channels.
