Indian defamation law operates on two tracks. Civil defamation under common-law tort principles, with damages and injunctions as remedies (no statutory cap). Criminal defamation under Sections 499 and 500 of the IPC (now BNS Sections 356 and 357), punishable with up to 2 years imprisonment. Online defamation adds Section 66A of the IT Act (struck down) and Section 79 (intermediary safe harbour). The K.S. A pre-publication suit for permanent injunction with an urgent application for ex parte interim injunction, filed before the appropriate civil court. Courts have granted urgent interim relief within 24 to 48 hours in matters with strong prima facie case and irreparable harm. We have obtained pre-publication injunctions from Delhi and Bombay High Courts on this timeline.
A defamatory post is going viral on social media. Can the platform be compelled to take it down?
Yes. Under Rule 3(2)(b) of the IT Rules 2021, intermediaries (Facebook, Instagram, X, YouTube) must remove content within 24 hours of a court order or government notification, or 72 hours of a user complaint accompanied by a self-certification. We file the user complaint, escalate to the platform grievance officer, and where necessary, secure a High Court takedown order.
Can I claim financial damages for defamation in India?
Yes, civil defamation has no statutory cap on damages. Courts have awarded damages from ₹1 lakh to ₹10 crore in landmark cases (R. Rajagopal v. State of TN; Subramanian Swamy v. Union of India; various commercial defamation matters). Quantum depends on the reach of the defamation, the actual or presumed harm, the defendant's conduct, and the plaintiff's standing.
My old criminal case shows up on Google when anyone searches my name. Can I get it removed?
Yes, through a Right-to-Be-Forgotten writ petition before the appropriate High Court. The Delhi, Karnataka, Gujarat, and Kerala High Courts have all granted RTBF relief in cases where: (1) the matter is stale, (2) the person was acquitted or matter was quashed, (3) ongoing public display causes disproportionate harm. We have secured de-indexing orders against Google and removal orders against news websites in 8 to 14 months.
A former employee posted defamatory Glassdoor / LinkedIn reviews about my company. What can I do?
Workplace defamation has two angles: (1) Civil defamation suit for damages and injunction, naming the ex-employee + the platform; (2) Breach-of-contract action if the ex-employee signed an NDA or non-disparagement clause.
