Will my UAE divorce (talaq or court order) be recognised in India?

A UAE court divorce is recognised in India under Section 13 CPC subject to the standard tests of competent jurisdiction, decision on merits, and conformity with Indian public policy. Triple-talaq pronounced in the UAE is no longer recognised in India after Shayara Bano (2017) and the Muslim Women (Protection of Rights on Marriage) Act, 2019. Court-decreed divorces are typically recognised; we file confirmatory petitions where remarriage in India is contemplated.

Should I make a DIFC will or an Indian will if I have assets in both?

Most NRIs in the UAE use both. A DIFC-registered will covers UAE-situs assets and avoids the default application of Sharia rules to non-Muslims. A separate Indian will covers Indian-situs immovable property under the Indian Succession Act. The two wills are drafted to be non-conflicting; LawCrust handles the Indian limb in coordination with your DIFC will-draftsperson.

Can I sell my Mumbai flat from Dubai without flying back?

Yes. Execute a Special Power of Attorney before the Indian Embassy in Abu Dhabi or Consulate in Dubai (Bur Dubai), or have a UAE-notarised POA attested at the MoFA and the Indian Embassy.
