A UAE court divorce is recognised in India under Section 13 CPC subject to the standard tests of competent jurisdiction, decision on merits, and conformity with Indian public policy. Triple-talaq pronounced in the UAE is no longer recognised in India after Shayara Bano (2017) and the Muslim Women (Protection of Rights on Marriage) Act, 2019. Court-decreed divorces are typically recognised; we file confirmatory petitions where remarriage in India is contemplated.
Most NRIs in the UAE use both. A DIFC-registered will covers UAE-situs assets and avoids the default application of Sharia rules to non-Muslims. A separate Indian will covers Indian-situs immovable property under the Indian Succession Act.
