Do I lose my OCI when I get foreign citizenship?

No. OCI is granted precisely because you have acquired foreign citizenship while retaining ties to India. What you must do is surrender your Indian passport at the Indian Consulate within reasonable time of acquiring foreign citizenship, failure to do so attracts penalty and complicates future OCI renewal.

Can my foreign spouse get OCI?

Yes, a foreign spouse of an Indian citizen or OCI cardholder is eligible for OCI after 2 years of marriage, subject to the standard OCI eligibility criteria. The application is filed online via the OCI services portal and processed by the Ministry of Home Affairs.

How do I bring my parents from India to live with me abroad?

Each destination country has its own pathway: USA, IR-5 immigrant visa for parents of US citizens; UK, Adult Dependent Relative visa (high evidentiary bar); Canada, Parent and Grandparent sponsorship under quota; Australia, Contributory Parent visa (long queue); UAE, sponsored family residency once you meet income thresholds. We assess eligibility and prepare the strongest application.

My OCI was cancelled or rejected. What can I do?

OCI miscancellation can be challenged via writ petition before the Delhi High Court (or appropriate High Court) under Article 226, citing procedural lapses, lack of natural justice, or arbitrary application of the cancellation grounds in the OCI Card rules. We have seen cancellations reversed where the order lacked reasons or was based on inaccurate facts. Filing within 6 months of the cancellation order is advisable.

I missed an OCI miscellaneous-services update after my passport reissue. Will this affect my travel?

The Ministry of Home Affairs has historically required OCI cardholders to update the linked Indian visa after each new passport. While enforcement has eased, you should still file the "Miscellaneous Services" application to update the linkage. Travelling on a new passport without the updated OCI U-sticker has caused boarding refusals at certain Indian airline counters; do not risk it.

Can I work in India on a tourist visa?

No. A tourist visa to India does not permit employment, even short-term consulting. The correct categories are Employment Visa, Business Visa (for meetings and discussions, not employment), or Project Visa (for specific industrial projects). Working on a tourist visa is a violation under the Foreigners Act, 1946, and attracts deportation, fine, and future visa refusal.

How long does it take to surrender Indian citizenship after taking foreign citizenship?

The renunciation process at the Indian Embassy or Consulate takes 2 to 4 months once the application is filed. You must submit your Indian passport for cancellation, pay the renunciation fee, and obtain the renunciation certificate. Until this is done, you are technically a dual citizen, which India does not permit, and you remain liable to Indian tax on global income, an important point.

Lookout Circular: How do I find out if there is an LOC against me?

No public database exists. Routes include: (1) an RTI application to the Bureau of Immigration, often replied to vaguely; (2) checking with the originating agency you suspect (CBI, ED, EOW); (3) attempting departure (risky, the LOC will be enforced). The Delhi High Court has held that a person facing LOC consequences is entitled to know of its existence, so the writ petition itself often produces disclosure.

I was stopped at the Delhi airport this morning. What is the fastest legal remedy?

A writ petition under Article 226 before the Delhi High Court, filed within 24 to 72 hours, with an interim prayer for departure permission for a specific upcoming trip. The court can direct the originating authority to show cause and can grant interim relief. We have filed and obtained interim relief within 48 hours in matters of urgent medical or business travel.

How long does an LOC stay valid?

Per the Bureau of Immigration guidelines (most recent consolidated circular), an LOC is valid for 1 year unless extended by the originating authority. The Delhi High Court in S. Martin v. Union of India (2024) reaffirmed the periodic-review requirement. Stale or unextended LOCs are quashable.

My elderly parent in the USA needs urgent surgery. Can the court grant me emergency travel?

Yes, and quickly. Courts treat medical emergencies, especially for parents or minor children, with priority. We file the writ with hospital records, doctor letters, and proposed travel dates; ex parte interim relief has been granted within 24 to 48 hours. Conditions are typically: deposit passport on return, furnish surety, no extension beyond the stated dates.

Will an LOC affect my job, visa renewal, or immigration to another country?

Possibly. An active LOC does not automatically appear on standard police-clearance certificates (PCC), but the underlying FIR/investigation usually does. Some embassies (UK, Schengen) ask specifically about pending criminal proceedings. Disclose accurately during visa renewals, lying typically causes greater harm than the underlying matter.

I am abroad. Can I file the LOC writ petition without coming to India?

Yes. The writ is filed by your Indian counsel under a properly attested Power of Attorney. Personal presence is rarely required at the urgent-listing stage, the court hears counsel. For the final hearing, presence may be requested; we appear by video where the court permits. The order, once obtained, is communicated to Bureau of Immigration before you travel.
